GDPR, DSG, and cross-border data transfer

Personal data of EU residents processed by our engineers requires a lawful transfer mechanism. Standard Contractual Clauses (2021 version) plus a short transfer impact assessment is the usual path. For health, finance, or public-sector clients we can add technical measures: EU-only hosting, VDI into your VPC, or pseudonymised datasets in India. Your DSB signs off once; we reuse the same framework for the life of the engagement.

Austrian VAT (USt) on imported services

Services from India to an Austrian business customer are generally subject to reverse charge under § 19 UStG. You self-account VAT on your return; there is no net VAT cost if you are fully entitled to deduct input tax. We provide invoices with the correct legal references and our UID if you need it for your books.

No Scheinselbständigkeit risk on your side

Scheinselbständigkeit (bogus self-employment) rules apply when someone looks like an employee but is contracted as a freelancer. Our engineers are employees of AllDomainSoft in India, not Austrian contractors. You buy a service from a foreign company. That structure is outside the scope of Austrian employee misclassification rules for your entity.

IP, NDAs, and Arbeitnehmererfindungsrecht

Every engineer signs work-for-hire and IP assignment before touching your repositories. Austrian employee invention law (ArbEG) does not apply to our staff because they are not your employees. Your code stays in your GitHub or GitLab; we do not retain license-back rights.

Questions from Austrian founders and IT leads

Do you work with Austrian clients already?

Can we pay in EUR?

Yes. EUR is the default for Austrian clients. SWIFT transfer to our international account, net-30 terms. Some clients use Raiffeisen or Erste Bank international desks; settlement is usually within a week.

Is English enough, or do we need German-speaking developers?

English is the working language on every engagement we run. We have engineers with conversational German for client calls and documentation, but we do not position German as a substitute for technical depth. If you need B2 German for end-user support tools, say so upfront and we will filter for it.

How does this fit with Advantage Austria or WKO programmes?

Advantage Austria promotes Austrian business abroad and helps international partners enter Austria. Using an Indian development partner does not conflict with WKO membership. Many Austrian exporters use offshore engineering for their digital products while selling physical goods or services through Advantage Austria channels. What about Works Council (Betriebsrat) if we are a larger company?

Betriebsrat co-determination applies to your Austrian employees, not to workers employed by a foreign vendor in India. Informing the BR about strategic outsourcing is sometimes wise politically, but there is no legal requirement to seek BR approval for a B2B contract with an Indian company.

Can engineers visit our office in Vienna?

Yes. Schengen business visas for Indian nationals typically take 3-6 weeks. We handle invitation letters and supporting documents. Some clients do quarterly visits the other direction (to Gurgaon) instead, which is often faster to arrange.

What is the minimum team size?

We will start with one engineer if the fit is right, but three or more makes the economics and team dynamics work better. Minimum engagement is usually three months.

How fast can someone start?

7-14 days for React, Node, Java, .NET, and PHP. Niche stacks (embedded, Rust, SAP ABAP) can take 3-4 weeks. We share a dated pipeline before you sign.
